1. Introduction
These Terms and Conditions (“Agreement”) govern the use of services and participation in treks, tours, and activities offered by Rushme Trill Treks Pvt Ltd (“Company”, “we”, “us”, or “our”). By booking a trip or accessing our website, the user (“you”, “your”, “participant”) agrees to be bound by this Agreement.
2. Definitions
- Participant: Any individual or group availing services from Rushme Trill Treks Pvt Ltd.
- Adventure Activities: Includes, but is not limited to, trekking, hiking, kayaking, camping, and forest or coastal expeditions.
- Confirmed Booking: A booking is considered confirmed upon full payment and issuance of a confirmation email or receipt.
- Event Leader: A designated guide or trek leader responsible for on-ground execution of the trip.
3. Booking & Confirmation
3.1 All bookings must be made via our website or through official contact channels.
3.2 Bookings are only confirmed upon full payment through our secure payment gateway.
3.3 The Company reserves the right to accept or decline any booking request without providing justification.
4. Participant Obligations
4.1 Participants must disclose accurate personal, medical, and emergency contact information during registration.
4.2 The participant affirms they are medically and physically fit for the activities enrolled in.
4.3 Participants must abide by all safety instructions issued by the Event Leader and support team.
5. Itinerary & Schedule
5.1 While every effort is made to adhere to the scheduled itinerary, the Company reserves the right to make changes due to weather, safety, or other force majeure circumstances.
5.2 The final itinerary shared before departure shall override all preliminary plans.
6. Cancellation Policy
6.1 Cancellation requests by the participant must be made in writing to info@treks-rush.me. 6.2 Cancellations made within 3 days of booking are eligible for a full refund, provided the trip is not scheduled within the next 7 days. 6.3 No refund is applicable for cancellations made within 7 days of the scheduled trip. 6.4 The Company reserves the right to cancel a trip due to minimum participant count not being met, extreme weather, or regulatory restrictions, in which case a full refund or rescheduling option will be offered.
7. Refunds
7.1 Refunds, if applicable, will be processed to the original method of payment within 7–10 business days.
7.2 Refunds are not applicable for partial attendance, early exit, or no-shows.
8. Risk Acknowledgement & Liability Waiver
8.1 Adventure travel involves inherent risks including, but not limited to, physical injury, wildlife encounters, natural disasters, and remote access limitations.
8.2 By confirming participation, the participant voluntarily assumes all such risks.
8.3 The Company is not responsible for loss, damage, or theft of personal belongings. 8.4 The Company is not liable for delays or changes caused by transportation breakdowns, third-party service providers, or governmental restrictions.
9. Code of Conduct
9.1 Participants must treat co-travelers, staff, and local communities with respect.
9.2 Consumption of alcohol, drugs, or any illegal substances during tours is strictly prohibited. 9.3 Disruptive behavior, harassment, or refusal to comply with the trek leader’s instructions may result in immediate removal without refund.
10. Intellectual Property
10.1 All content including logos, photos, itineraries, and documentation published on the website is the property of Rushme Trill Treks Pvt Ltd.
10.2 Any unauthorized reproduction or commercial use of content is prohibited.
11. Force Majeure
11.1 Rushme Trill Treks Pvt Ltd shall not be liable for any failure or delay in performing its obligations due to events beyond its control, including but not limited to acts of God, war, natural disasters, epidemics, and government regulations.
12. Dispute Resolution & Jurisdiction
12.1 In case of disputes, the participant must first approach the Company through official communication for resolution. 12.2 All legal matters arising under these terms shall fall under the jurisdiction of the courts in Goa, India.
