2. Adventure Activity Disclaimer
2.1 Participation in outdoor activities such as trekking, hiking, and nature exploration involves inherent risks, including injury, environmental hazards, wildlife, and unpredictable weather.
2.2 All such activities are voluntarily undertaken by the participant at their own risk.
2.3 Rushme Trill Treks Pvt Ltd, its staff, guides, and affiliates are not liable for any loss, damage, illness, injury, or death that occurs during or as a result of participation in any of our activities, unless arising from gross negligence proven in court.
3. Assumption of Risk
3.1 By proceeding with a booking, participants:
- Affirm they understand the physical and environmental risks involved
- Agree to undertake the trek/tour with full awareness of these risks
- Assume responsibility for their own safety, behavior, and health
4. Force Majeure Clause
4.1 Rushme Trill Treks Pvt Ltd shall not be held responsible for failure to perform its obligations due to events beyond our control, including:
- Acts of God (natural calamities, floods, storms)
- Civil unrest, strikes, or war
- Government restrictions or pandemic-related travel bans
4.2 In such cases, trips may be rescheduled or credited for future use but are not subject to refund unless explicitly stated.
5. Third-Party Services Disclaimer
5.1 We collaborate with independent third-party service providers for transport, accommodation, meals, and local logistics. While we choose our partners with care:
- We do not assume liability for acts, omissions, or service failures of these third parties
- Participants must raise any service-level complaints directly or through our post-trip grievance process
6. Jurisdiction & Governing Law
6.1 All disputes, claims, or legal proceedings arising from the use of Rushme Trill Treks Pvt Ltd services shall be:
- Governed by the laws of the Republic of India
- Subject exclusively to the jurisdiction of courts located in Goa, India
6.2 Participants agree not to initiate legal proceedings in any jurisdiction outside of Goa, India.
7. Severability
If any provision of this disclaimer is found invalid or unenforceable under Indian law, the remainder of the document shall continue to be valid and enforceable to the fullest extent permitted.
